Six Sigma HVAC Services alleged to owe more than $15,000 for contributions

LOS ANGELES – A Pomona heating and air conditioning and air and water balancing contractor is alleged to have failed to pay contributions on behalf of its employees.

Board of trustees of the Sheet Metal Workers' Pension Plan of Southern California, et al. filed a complaint on June 27 in the U.S. District Court for the Central District of California against Six Sigma HVAC Services and Robert Carlos Zaragoza alleging breach of collective bargaining agreement.

According to the complaint, the plaintiffs allege that they have been damaged due to unpaid and late-paid contributions. The plaintiffs hold Six Sigma HVAC Services and Zaragoza responsible because the defendants allegedly have failed and refused to remit contributions for December 2016, January and February 2017 and through the present.

The plaintiffs seek enjoin the defendant, unpaid contributions that exceed $15,766.64, audit costs, liquidated damages that exceed $3,153.33, all legal fees, interest of $1,576.66, punitive damages, actual damages that exceed $20,496.63, and any other relief as the court deems just. They are represented by Laurie A. Traktman of Gilbert & Sackman in Los Angeles.
