Ex-employee accuses home loans business of disability discrimination

SAN DIEGO — A San Diego woman is suing a home loans business, alleging disability discrimination in the workplace.

Suzanne T. Gonzales filed a complaint July 5 in U.S. District Court for the Southern District of California against Caliber Home Loans Inc., and Does 1-20, alleging the defendants violated the American with Disabilities Act (ADA) and California Labor Code.

According to the complaint,  in June 2016, Gonzales was diagnosed with breast cancer that required to undergo periodic treatment. While still employed as a property solutions specialist by Caliber Home Loans, the suit says, and with full knowledge of her condition, Gonzales was given increased performance requirements and was repeatedly reprimanded for her slower work pace. She was terminated March 7, 2017 because she did not meet her monthly quotas, the lawsuit states. 

The plaintiff alleges the defendants failed to engage in the interactive process, failed to provide reasonable accommodation related to her disability and terminated her employment due to her condition.

Gonzales seeks trial by jury, general, compensatory and punitive damages, interest, costs of suit, attorney fees, and all other proper relief. She is represented by attorneys Stefano Abbasciano and Antonio Valla of Valla & Associates Inc. PC in San Francisco.
