Two consumers seek damages over allegations Ford Focus has defects

FRESNO – Two consumers claim a vehicle they purchased has defects and has not been repaired to conform to the warranties.

Jose Santiago Lao and Ariana Ortiz filed a complaint on June 20 in the Fresno County Superior Court against Ford Motor Co. and Does 1-20 alleging that the manufacturer and distributors failed to comply with the Magnuson-Moss Warranty Act and Song-Beverly Warranty Act regulations.

According to the complaint, the plaintiffs allege that on May 17, 2014, they purchased a used 2013 Ford Focus for the installment contract of $23,545.48. The suit states the plaintiffs experienced nonconformities with the vehicle, which included transmission malfunctions, acceleration concerns and other issues. They allege they took the vehicle to an authorized service and repair facility but the vehicle has failed to be repaired to conform to the warranties.

The plaintiffs request a trial by jury and seek replacement or restitution, incidental and consequential damages, attorney’s fees, costs and expenses and such other legal and appropriate relief. They are represented by Christopher M. Lovasz and Charles J. Lee of Consumer Legal Services PC in Long Beach.
