Tenant alleges Coalinga property has mold, no hot water

FRESNO – A tenant alleges a property she rented was not maintained.

Danielle Smith filed a complaint on June 21 in the Fresno County Superior Court against Robin E. Scrivner, Rhoda Linch and Does 1-100 alleging breach of contract and other counts.

According to the complaint, the plaintiff moved into the defendants' Coalinga property in July 2013 as a tenant. She alleges the defendants have caused slum and substandard living conditions because they have not maintained the property, including leaking walls and plumbing, toxic mold and mildew and no hot water.

The plaintiff holds Scrivner, Linch and Does 1-100 responsible because the defendants allegedly failed to correct the conditions that rendered the property a nuisance.

The plaintiff seeks general, special and punitive damages; attorney’s fees and costs; pre- and post-judgment interest; and such other just and proper relief. She is represented by Jonathan Nielsen, Kirt J. Peterson and Tanner Nielsen of Nielsen, Peterson & Nielsen LLP in Oxnard.
