Nutritional ingredients business accuses competitors of patent infringement

SAN DIEGO — A California nutritional ingredients business is suing competitors, alleging patent infringement.

Certified Nutraceuticals Inc. filed a complaint July 11 in U.S. District Court for the Southern District of California against Nutrawise Inc., doing business as Youtheory, Darren Rude, Neocell Corporation, Collagen M.D. Inc, Axe Wellness, Dr. Venessa's Formulas, Iris Trading, et al, alleging they manufactured and sold products that infringes the plaintiff's patents.

According to the complaint, Certified Nutraceuticals suffered damages to its business from having its patented inventions infringed upon. The plaintiff alleges the defendants purposely place products that infringes on the plaintiff's patents for products like vitamin supplements and joint support capsules into the stream of commerce.

Certified Nutraceuticals seeks trial by jury, enjoin the defendant, damages, interest, compensatory damages, legal fees, punitive damages and all other relief the court deems just. They are represented by attorney Daryoosh Khashayar of Khashayar Law Group in Vista, California.
