Employee alleges marketing business violated family leave act

SAN FRANCISCO — A California man is suing a Wisconsin marketing business, alleging discrimination, retaliation and violation of the Family and Medical Leave Act.

Kemp Bennett of Marin County filed a complaint July 13, in the U.S. District Court for the Northern District of California against GMR Marketing LLC of New Berlin, Wisconsin, alleging the defendant interfered with the plaintiff's rights to FMLA protected leave.

According to the complaint, Bennett, who began working for GMR in 2014, suffered monetary damages from being terminated April 17 for going on a FMLA leave. The plaintiff alleges GMR Marketing terminated his employment in retaliation for asking for a medical leave due to atrial fibrillation. The plaintiff is 62.

Bennett seeks trial by jury, restrain the defendant, damages, monetary damages, liquidated damages, punitive damages, legal fees and all other relief the court deems just. He is represented by attorney Robert W. Ottinger of The Ottinger Firm PC in San Francisco.
