LOS ANGELES — Japanese and California beauty products designers are suing competitors, alleging trademark infringement and unfair competition.
YS Park Professional, Inc., Park Way Co. Ltd., and Passion Beauty Inc. filed a complaint July 10 in U.S. District Court for the Central District of California against Saco Store, JSIU Beauty Co. Ltd., Guangzhou Dinshine Hair Products Co. Ltd., Helenere, Ismart Hair, Eagle Fortressm Canway Co. Ltd. and Does 1-25, alleging they illegally used the plaintiffs' trademark on their products.
According to the complaint, the plaintiffs suffered damages to their business and reputation from having their trademark used on other beauty products. The plaintiffs allege the defendants are confusing consumers by using the same trademark as the plaintiffs in order to deceive them into buying their products.
The plaintiffs seek trial by jury, enjoin the defendant, order the defendant to deliver all infringing materials to the plaintiff, all profits, monies and advantages obtained by the defendant, damages and remedies of at least $200,000, statutory damages of $200,000, statutory damages of up to $2 million for willful use of one counterfeit mark, punitive and exemplary damages, legal fees and all other relief the court deems just.
