5 employees allege apparel business violated wage laws

LOS ANGELES — Five employees have filed a class action lawsuit against a California apparel business, alleging unpaid wages and violation of workers compensation acts.

Anner Rodriguez, Erick Rodriguez, Jose Benavides, David Benavides and Melvin Cuadra filed a complaint, indivdually and on behalf of others similarly situated, July 11 in U.S. District Court for the Central District of California against Famma Group Inc. of Vernon, Don X. Ho, Joe Kamari, Jesus Gonzalez, Tiburcio Sanchez, Erick Ovando and Does 1-10, alleging they failed to pay fair wages in violation of the Fair Labor Standards Ac.

According to the complaint, the plaintiffs worked for more than 40 hours per week without being paid any overtime compensation as required by FLSA. The plaintiffs allege the defendants failed to provide accurate itemized statements for the plaintiffs' wages.

The plaintiffs seek trial by jury, liquidated damages, punitive damages, unpaid overtime compensation, up to $5,000, interest, all legal fees and all other relief the court deems just. They are represented by attorney Eliyahu Kaplunovsky of Sunnyvale, California.
