U.S., floor coverings business allege insurance companies breached contract

SANTA CLARA — The U.S. government, through a California floor coverings business, is suing insurance companies, alleging breach of contract.

The United States of America, for the use and benefit of Corban Floor Coverings Inc., filed a complaint July 20 in U.S. District Court for the Northern District of California against Kirlin Builders LLC, Chubb Surety, Federal Insurance Company, Liberty Mutual Insurance Company, and Does 1-20, alleging they failed to pay the plaintiff for materials and services.

According to the complaint, the U.S. suffered monetary damages for not being paid nearly $120,000 for floor coverings work. The plaintiff alleges the defendants refused to pay the U,.S. despite its demands for payment for completing the terms of the subcontract.

The U.S. and Corban Floor Coverings seek principal and interest, the sum of $119,063 plus interest at the rate of 1.5 percent per month, all legal fees and all other relief the court deems just. They are represented by attorney Dawna J. Cilluffo of DC Law, Dawna J. Cilluffo APC in Santa Clara.
