Mother alleges Credit One Bank made illegal phone calls to 11-year-old child

SACRAMENTO — An 11-year-old child, through its mother, is suing Credit One Bank, alleging violation of telephone harassment statutes.

N.L., a minor, by his mother and natural guardian Sandra Lemos of Placer County, filed a complaint July 18 in U.S. District Court for the Eastern District of California against Credit One Bank NA and John Does 1-25, alleging they illegally made more than 85 collection calls to N.L., a minor, violating the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that N.L. suffered damages from receiving several collection calls. The plaintiff alleges the defendants inexplicably called N.L. on his cellular telephone more than 85 times in an attempt to collect an alleged debt.

N.L. and Lemos seeks trial by jury, statutory damages of $500 for each TCPA violation, treble damages of $1,500, actual and punitive damages, legal fees and any other relief the court deems just.
