Fresno County couple accuses BMW of breach of warranty

FRESNO — A Fresno County couple is suing BMW, alleging breach of implied warranty and breach of warranty.

Richard Anthony Beshwate Jr. and Bonnie Joy Beshwate filed a complaint Feb. 17 in Fresno County Superior Court against BMW of North America LLC, Carmax Auto Superstores California LLC, and Does 1 through 500, alleging they failed to repair the defects found in the used BMW purchased by the plaintiffs.

According to the complaint, the Beshwates suffered damages from purchasing a BMW 550 on Nov. 4, 2014, for $38,895.87 that had several defects. The plaintiffs allege the defendants failed to repair the vehicle despite several efforts given to them and that the defendants misrepresented to the Beshwates the actual mechanical condition of the vehicle.

The Beshwates seek trial by jury, actual damages, civil penalty, restitution, interest, all legal fees and all other relief the court deems just. They are represented by attorneys Emmettt Gilman and Michele M. Tuman of The Gilman Law Firm APC in San Francisco.
