Employee alleges auto business violated labor code

SAN FRANCISCO — An employee has filed a class action lawsuit against auto parts businesses, alleging violation of federal law.

Adrian Aguilar filed a complaint, individually and on behalf of all others similarly situated, July 27 in U.S. District Court for the Northern District of California against CSK Auto Inc., O'Reilly Automotive Stores Inc., and Does 1-10, alleging they failed to provide adequate compensation to the plaintiff for his work.

According to the complaint, Aguilar suffered damages from not being given proper rest breaks or being paid properly during his employment. The plaintiff alleges the defendants failed to provide him with an accurate wage statement.

Aguilar seeks trial by jury, all amounts due, wages, penalties, interest, all legal fees, restitution, injunction, statutory damages, and all other relief the court deems just. He is represented by attorney Carey A. James of Aiman-Smith Marcy in Oakland.
