SAN FRANCISCO — A San Francisco condominium business is suing a New York real estate company, alleging fraud and negligent misrepresentation.
Mission Millennium LLC filed a complaint April 21 in San Francisco County Superior Court against Millennium Partners I Inc., Millennium Partners Management LLC, Mission Street Development LLC, Mission Street Holdings LLC, Transbay Joint Powers Authority and Does 1 though 100, alleging they misled the plaintiff into paying a higher price to purchase a San Francisco condo tower that was sinking into the ground.
According to the complaint, Mission Millennium suffered monetary damages from purchasing the Millennium Towers property at 301 Mission St., San Francisco, that was negligently misrepresented. The plaintiff alleges the defendants did not inform it that the building already had sunk more than 8 inches by time the construction was completed in order to sell the the building for a higher price.
Mission Millennium seeks trial by jury, compensatory, economic and general damages, legal fees, punitive damages, interest, and all other relief the court deems just. It is represented by attorney Niall P. McCarthy of Cotchett, Pitre & McCarthy, LLP in Burlingame, California.
