SAN FRANCISCO — A San Jose man has filed a class action lawsuit against a mortgage company, alleging unpaid wages, violation of applicable minimum wage laws, violation of state law and violation of workers compensation acts.

Robert W. Ahlstrom filed a complaint, individually and on behalf of all others similarly situated, Aug. 2 in U.S. District Court for the Northern District of California against DHI Mortgage Company GP Inc., D.R. Horton Inc., and Does 1 through 50, alleging they failed to pay fair wages, in violation of the Fair Labor Standards Act.

According to the complaint, Ahlstrom suffered monetary damages from not being paid minimum wages during his employment that began in July 2-15. The plaintiff alleges the defendants failed to pay overtime wages to Ahlstrom, including providing adequate meal and rest periods, in violation of FLSA.

Ahlstrom seeks trial by jury, unpaid wages, actual damages, liquidated damages, restitution, interest, statutory penalties, all legal fees and all other relief the court deems just. He is represented by attorneys Shaun Setareh and Thomas Segal of Setareh Law Group in Beverly Hills.
