Employee alleges Abbott Labs violated ERISA

SACRAMENTO — A Placer County man is suing Abbott Labs, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Scott McDaniel filed a complaint Aug. 2 in U.S. District Court for the Eastern District of California against Abbott Laboratories Group Health Care Plan, Mary Moreland, Matrix Absence Management Inc., Quantum Health, also known as Abbott Care Coordinators, and Does 1-25, alleging they wrongfully denied the plaintiff's claim for benefits.

According to the complaint, McDaniel suffered damages from wrongfully having his benefits denied. The plaintiff alleges the defendants refused to honor their coverage of McDaniel's health care benefits, requiring him to pay $30,000 for medical expenses.

McDaniel seeks to order the defendant to pay medical expenses by the plaintiff, all legal fees, enjoin the defendant, and all other relief the court deems just. He is represented by attorney Natalia D. Asbill of Perkins & Associates in Sacramento.
