Client alleges North America Life violated ERISA

LOS ANGELES — A client is suing North America Life, alleging breach of contract.

Jorge Varela filed a complaint Aug. 10 in U.S. District Court for the Central District of California against Life Insurance Company of North America, alleging the insurance firm wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Varela became disabled due to back pain in 2014 and applied for disability benefits. The suit says the benefits were denied because North America Life failed to reach a decision at the allowable time regarding the plaintiff's appeal for his claim.

Varela seeks benefits due, plus interest, legal fees and all other relief the court deems just. He is represented by attorneys Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario, California.
