Marin County real estate agent alleges New York corporation violated TCPA

SAN FRANCISCO — A Marin County real estate agent has filed a class action lawsuit against a  New York corporation, alleging violation of telephone harassment statutes.

Adam Gavzer filed a complaint, individually and on behalf of all others similarly situated, Aug. 7 in U.S. District Court for the Northern District of California against American Coradius International LLC, and Does 1-10, alleging they illegally called the plaintiff several times in an attempt to collect an alleged debt, violating the Telephone Consumer Protection Act.

According to the complaint, in 2016, Gavzer suffered damages from receiving several unwanted calls on his cellular telephone, which, as a real estate agent, he needs to keep open for business calls. The plaintiff alleges the defendants illegally used an automatic telephone dialing system to call Gavzer despite his request to stop calling.

Gavzer seeks trial by jury, statutory damages of $500 per violation, treble statutory damages of $1,500 per violation, enjoin the defendant, legal fees and all other relief the court deems just.
