Oakland company alleges customer breached contract

SAN FRANCISCO — An Oakland company is suing a customer, alleging breach of contract and owing more than $62,000.

M. Gutierrez Inc. filed a complaint Aug. 8 in U.S. District Court for the Northern District of California against Bara Infoware Inc., North American Specialty Insurance Company and Does 1-5, alleging they failed to pay the plaintiff based on their subcontract agreement of October 2014.

According to the complaint, M. Gutierrez suffered monetary damages as the result of not being paid for its work at Fort Hunter Liggett in Monterey County. The plaintiff alleges the defendants failed to make a final payment in the amount of $62,532.70.

M. Gutierrez damages of $62,532.70, interest, all legal fees and all other relief the court deems just. They are represented by attorney William J. Braun of Braun & Melucci LLP in La Jolla.
