Sheet metal workers accuse heating business of violating ERISA

SAN FRANCISCO — A group of sheet metal workers are suing a heating and air conditioning business, alleging breach of contract.

The boards of trustees of the sheet metal workers pension trust of Northern California, Sheet Metal Workers Local 104 supplemental pension fund, Sheet Metal Workers Local 104 and Bay Area industry training fund, trustees Rick Werner and Sean O'Donoghue, and the Sheet Metal Workers International Association Local Union 104 filed a complaint Aug. 24 in U.S. District Court for the Northern District of California against Martin Guidi, individually and doing business as Crane Heating & Air Conditioning, Crane Air Conditioning Inc., alleging failure to make their monthly contributions to the plaintiff.

According to the complaint, the plaintiffs suffered monetary damages as the result of unpaid and late paid contributions. The plaintiffs allege the the defendants breached their bargaining agreement by failing to remit their employees' monthly contribution.

The plaintiffs seek to enjoin the defendant, unpaid contributions, liquidated damages, interest, legal fees and all other relief the court deems just. They are represented by attorneys Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corporation in San Francisco.
