Mother alleges plan administrator violated ERISA

SAN FRANCISCO — A mother is suing a health plan, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Carol Meyers of Santa Barbara County filed a complaint Aug. 25 in U.S. District Court for the Northern District of California against Kaiser Foundation Health Plan Inc. and Does 1-10, alleging they wrongfully denied the plaintiff's claim for benefits for her daughter.

According to the complaint, Meyers, the mother and guardian of her minor daughter Abigail Meyers, suffered damages from having her benefits denied. The plaintiff alleges the defendants failed and refused to pay for the medical expenses for Abigail Meyers, whose severe medical issues resulted in a suicide attempt.

Carol Meyers said she incurred $65,000 in medical expenses that were not reimbursed.

Meyers seeks benefits, legal fees, interest and any other relief the court deems just. She is represented by attorney Christian J. Garris of Law Offices of Christian J. Garris in Los Angeles.
