Kmart accused of copyright infringement

LOS ANGELES — A California visual artist is suing Kmart, alleging copyright infringement.

Paul Benavidez filed a complaint Aug. 23 in U.S. District Court for the Central District of California against Kmart Corporation, Home Products International-North America Inc. and Does 1 through 25, alleging they illegally copied the plaintiff's artwork without permission.

According to the complaint, Benavidez suffered damages from having his "The Enchanted Loom" artwork illegally copied and used without his consent. The plaintiff alleges the defendants sells a leg iron board that features the plaintiff's design.

Benavidez seeks trial by jury, injunction against the defendants, monetary damages, profits, legal fees and any other relief the court deems just. He is represented by attorney Joseph Rocco Jones of Law Office of Ball & Yorke in Ventura, California.
