North America Life accused of violating ERISA

LOS ANGELES — A policy holder is suing North America Life, alleging breach of contract and violating the Employee Retirement Income Security Act.

William Phillips filed a complaint Aug. 29 in U.S. District Court for the Central District of California against Life Insurance Company of North America alleging the defendant wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Phillips became disabled due to chronic joint pain and other health issues. The suit says Phillips made a claim for disability benefits that was approved but later terminated in October. 2016. 

The plaintiff alleges North America Life wrongfully upheld its decision to deny Phillips' benefits based on the findings of physicians who were financially biased.

Phillips seeks benefits due, plus interest, legal fees and all other relief the court deems just. He is represented by attorney Phillip S. Bather of DarrasLaw in Ontario, California.
