California software company accuses competitors of copyright infringement

SAN FRANCISCO — A San Jose corporation is suing Florida competitors, alleging copyright infringement and unfair competition.

Adobe Systems Inc. filed a complaint Sept. 8 in U.S. District Court for the Northern District of California against NA Tech Direct Inc. of Miami formerly known as Tigerdirect, Inc. and Tiger Direct Inc., Avenue Industrial Supply Company Limited, formerly known as NA Tech Canada.Ca Inc. formerly known as Tigerdirect.Ca, Inc., SYX Distribution Inc., SYX Services, Inc., Systemax, Inc. and Does 1-10, alleging the defendants illegally sell unauthorized copies of plaintiff's software.

According to the complaint, Adobe Systems suffered damages to its business from having unauthorized copies of its software sold to the public by the defendants. The plaintiff alleges the defendants illegally sell and distribute EDU copies of Adobe's software outside the plaintiff's licensing restrictions to end users.

Adobe Systems seeks trial by jury, profits and damages, actual damages, statutory damages, consequential and compensatory damages, legal fees and all other relief the court deems just. It is represented by attorneys Christopher Q. Pham and Nicole Drey Huerter of Johnson & Pham LLP in Woodland Hills, California.
