L.A. fabrics business accuses J.C. Penny of copyright infringement

LOS ANGELES — A Los Angeles fabrics business is suing J.C. Penny and other garment vendors, alleging copyright infringement.

Star Fabrics Inc. filed a complaint Sept 5 in U.S. District Court for the Central District of California against Cejon Accessories Inc., J.C. Penny Company, Inc., and Does 1 through 10, alleging they illegally copied and reproduced plaintiff's floral fabric designs.

According to the complaint, Star Fabrics suffered damages from having its floral fabric designs copied. The plaintiff alleges the defendants illegally sell garments made out of fabrics that bear the plaintiff's designs.

Star Fabrics seeks trial by jury, enjoin the defendant, all profits, statutory damages, legal fees, interest and all other relief the court deems just. They are represented by attorney Stephen M. Doniger A. Burroughs and Howard S. Han of Doniger/ Burroughs in Venice, California.
