LOS ANGELES — A policy holder is suing North America Life, alleging breach of contract and violating the Employee Retirement Income Security Act.
Kevin Miller filed a complaint Sept. 14 in U.S. District Court for the Central District of California against Life Insurance Company of North America, alleging the defendant wrongfully denied the plaintiff's claim for disability benefits.
According to the complaint, Miller, who worked as a service adviser for Interstate, became disabled due to several medical condition including a brain tumor. The suit says Miller applied for disability benefits but was denied.
The plaintiff alleges North America Life wrongly upheld its decision to deny Miller's disability benefits despite having sufficient medical proof to support his claim.
Miller seeks benefits due, plus interest, legal fees and all other relief the court deems just. He is represented by attorney Frank N. Darras of DarrasLaw in Ontario, California.
