LOS ANGELES — A California business is suing Groupon Inc. and Global Phoenix Computer Technologies Solutions Inc., alleging copyright infringement and unfair competition.
Paint Zoom LLC of Sherman Oaks filed a complaint Sept. 14 in U.S. District Court for the Central District of California against Groupon Inc., and Global Phoenix Computer Technologies Solutions Inc.,alleging they sell counterfeit copies of the plaintiff's product.
According to the complaint, Paint Zoom, an affiliate of Ideal Living Managment, suffered damages to its business and reputation as the result of having its product copied. The plaintiff alleges the defendants sell a counterfeit paint sprayer bearing the name "Paint Zoom."
Paint Zoom seeks trial by jury, enjoin the defendant, destruction of all infringing products, profits and damages, actual damages, statutory damages, treble damages, exemplary or punitive damages, legal fees and all other relief the court deems just. They are represented by attorney Steven W. Ritcheson of Insight PLC in Chatsworth.
