Ice tea company accuses competitor of trademark infringement

LOS ANGELES — A Santa Barbara ice tea company is suing a competitor, alleging unfair competition.

Boston Iced Tea Company Inc. filed a complaint Sept. 15 in U.S. District Court for the Central District of California against BBK Pictures Inc., alleging the competitor illegally intends to use the BBK trademark to advertise its products.

According to the complaint, Boston Iced Tea suffered damages to its business because the defendant claims ownership of the BBK mark despite having abandoned its application with the United States Patent and Trademark Office.

Boston Iced Tea seeks trial by jury, reversing the Trademark Trial and Appeal Board decision dated July 20, all legal fees and all other relief the court deems just. It is represented by attorney Roger N. Behle Jr. of Foley Bezek Behle & Curtis LLP in Costa Mesa, California.
