LOS ANGELES – A Los Angeles County man alleges his insurance company wrongfully denied to pay for his medical expenses.
Jose C. Rivera filed a complaint on Sept. 18 in the U.S. District Court for the Central District of California against Health Net of California Inc. and Does 1-10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2016, he underwent several procedures due to the cancerous brain tumor found on his brain while he was covered under the defendants' plan. He alleges that the cost of his treatment exceeded $800,000 and the defendants failed to pay $69,288.16 of the cost of his care.
The plaintiff holds Health Net of California Inc. and Does 1-10 responsible because the defendants' denial to pay his expenses allegedly is without just cause.
The plaintiff seeks benefits payable to the plaintiff under the plan in the amount of the total medical bills plus interest and costs, all legal fees, interest and any other relief as the court deems just.
