Individuals are suing vacation resort club and agents for violation of TCPA

LOS ANGELES — A California man has filed a class action lawsuit against a vacation resort club, alleging violation of the Telephone Consumer Protection Act (TCPA).

Jeremy Dickson filed a complaint, individually and on behalf of all others similarly situated, Sept. 18 in U.S. District Court for the Central District of California against Sor Technology LLC and Does 1-10, alleging they violated TCPA through intrusive and unwanted phone calls.

According to the complaint, in June 2017, Dickson and other similarly situated recipients have suffered from abuse and harassment, including invasion of their privacy and intrusion on their seclusion, caused by the defendants' unauthorized calls to solicit services. The suit says these calls took place despite the recipients' enrollment to the National Do-Not-Call Registry. 

The plaintiffs allege the defendants failed to establish and implement reasonable practices and procedures to prevent violations, called Dickson with such frequency meant to abuse or harass, and contacted him without prior express consent.

Dickson seeks trial by jury, statutory damages of $500 for each and every violation and $1,500 for each and every willful violation, injunctive relief and all other relief the court deems just.
