Construction workers trust fund alleges breach of contract

LOS ANGELES — A construction workers trust fund administrator is suing a San Diego company, alleging breach of contract.

Construction Laborers Trust Funds for Southern California Administrative Company (ADMINCO) filed a complaint Sept. 21 in U.S. District Court for the Central District of California against Mek Enterprises Inc., Marc Kranz, Marilyn Rosela, et al.,alleging they breached good faith and fair dealing.

According to the complaint, ADMINCO has suffered economic injuries, due to the wrongful conduct of the defendants. The suit says the defendants failed to timely remit monthly contributions to the trust funds for work performed, penalty, interest, payment bond and other law pursuant to agreement and the labor code. 

The plaintiff alleges the defendants deducted the monthly contributions due to the trust funds for such covered work, but failed to submit monthly contributions due the trust funds,.

ADMINCO seeks trial by jury, injunctive relief, monthly contributions, interest, costs of suit, and all other relief the court deems appropriate. It is represented by attorneys Alexander B. Cvitan, Marsha M. Hamasaki and Peter A. Hutchinson of Reich, Adell & Cvitan APLC in Los Angeles.
