Consumer alleges debt collector violated phone privacy law

LOS ANGELES — A Los Angeles County woman is suing an Anaheim, California, debt collector, alleging violation of telephone harassment statutes.

Cynthia Castanon filed a complaint Sept. 21 in U.S. District Court for the Central District of California against LoanMe Inc. alleging intrusive and unwanted phone calls in violation of the Telephone Consumer Protection Act.

According to the complaint, in May 2017, Castanon sustained actual damages including embarrassment, emotional and mental pain and anguish from receiving calls from the defendant to her cellular phone in an attempt to collect an alleged debt. 

The suit says LoanMe continued its barrage of calls despite Castanon's revocation of consent to be called and the faxing of a letter demanding the defendant contact the plaintiff through written communications exclusively. 

The plaintiff alleges LoanMe called her with such frequency as to to abuse or harass, and contacted the plaintiff without prior express consent.

Castanon seeks trial by jury, judgment against defendant, statutory damages of $500 for each and every negligent violation and $1,500 for each and every knowing and/or willful violation, declaratory judgment, actual damages, costs, attorney fees and all other relief the court deems appropriate.
