FRESNO — A consumer is suing an auto dealer and agent, alleging breach of contract and fraud.
Robert Endara filed a complaint Aug. 25 in Fresno County Superior Court against Matthew Gregory doign business as Gregory Motorsports, Shelby American Inc. and Does 1-50, alleging they breached their duties of good faith and fair dealing.
According to the complaint, on Jan. 24, 2015, Endara suffered economic damages from entering into a verbal agreement with the defendants for the purchase of two 50th anniversary Shelby Cobras rollers with total purchase price of $160,000 each. Rollers are complete models of vehicles that lack engines and transmission.
Subsequently, the suit says, Endara was informed one of the Cobras was sold to a third party and he was forced to accept an inferior non-50th anniversary car without badges.
The plaintiff alleges the defendants failed and refused to deliver the vehicle ordered and paid for, and failed and refused to provide documents demonstrating the joint ownership of the Cobra.
Endara seeks trial by jury, compensatory damages of not less than $120,000, trebled to not less than $360,000, punitive damages, costs of suit, attorney fees and all relief the court deems just. He is represented by attorney Justin D. Harris of Harris Law Firm PC in Fresno.
