FRESNO — A Los Angeles County band management company is suing a concert promoter, alleging misappropriation of likeness, unfair competition and unjust enrichment.
JRJ Corporation filed a complaint Aug. 25, in the Fresno County Superior Court against Edgar Muñoz Empresa MB Inc. and Does 1-10, alleging they breached their duties of good faith and fair dealing regarding an Aug. 19 concert in Fresno.
According to the complaint, JRJ has been harmed and damaged in reputation, personal feelings, professional standing and loss of publicity value. The suit blames the defendants for malicious intent in utter disregard for the plaintiff's well being and reputation to use the name, identity, persona, images and likeness of Alta Consigna
The suit states Alta Consigna is a musical group managed by JRJ and it was part of a promotion for a concert Aug. 19 in Fresno that was being organized by the defendants. The lawsuit states JRJ never agreed with the defendants to have Alta Consigna perform at the Aug. 19 event.
The plaintiff alleges the defendants wrongly utilized the name, identity, persona, images and likeness of the group without any consent or authority from the plaintiff.
JRJ Corporation seeks trial by jury, general, compensatory, nominal and special damages, disgorgement of the defendants’ profits, equitable relief, punitive and exemplary damages, attorney fees and costs, interest, and all further relief the court deems just.
