Insurance company alleges motorist owes more than $31,000

FRESNO — An insurance company is suing a motorist, alleging refusal to pay for damages after causing a vehicular collision.

Topa Insurance Company filed a complaint Aug. 29 in Fresno County Superior Court against Eusebio Paulino and Does 1 through 10, alleging the defendants operated a vehicle in a careless manner, causing a collision, personal injuries and property damage to an insured client.

According to the complaint, on May 14, 2014, Topa's insured client, Leonardo Hernandez Gomez, suffered damages after a vehicle collision and filed for uninsured motorist coverage. Topa alleges it has performed its obligation by paying the sum of $31,053.57 as coverage to Gomez but has failed to receive payment from the defendants as subrogation. 

The plaintiff alleges the defendants have failed to pay the subrogation fees for property damages and personal injury after causing a vehicular collision.

Topa Insurance seeks trial by jury, judgment of $31,053.97 together with interest at the rate of 10 percent per annum for costs of suit, and all other relief the court deems just and proper. It is represented by attorney Todd F. Haines of Law Offices of Todd F. Haines in Agoura Hills.
