Businessman accuses partners of fraud

SAN DIEGO — A San Diego County man is suing business partners, alleging civil conspiracy, fraud, negligent misrepresentation and unjust enrichment.

Rajesh Patel filed a complaint Sept. 26 in U.S. District Court for the Southern District of California against Vina Patel and Paresh Patel and Does 1-10, alleging they breached their duties of good faith and fair dealing.

According to the complaint, in 2015, Rajesh Patel was financially harmed in not being able to recover $44,164 he lent to the defendants and $25,000 as initial capital for a fraudulent investment where the defendants conspired to defraud the plaintiff. 

The plaintiff alleges the defendants coaxed loan and investment monies from him with no intent of paying back the full amount, and utilized the funds he provided for their own advantage.

Rajesh Patel seeks trial by jury, actual damages of $44,164 and $25,000, statutory damages, punitive damages of $50,000, attorney fees, interest, costs of suit and all relief the court deems proper. He is represented by attorneys Andrew R. Stilwell and Heidi E. Brown of Patel / Stilwell LLP in San Diego.
