Former employee alleges wrongful termination

FRESNO — A Fresno County woman is suing her former employers, alleging breach of contract, retaliation and wrongful termination.

Angel Rivera filed a complaint Aug. 31 in Fresno County Superior Court against HCI Systems Inc., Jerry (Jesus) Pacheco, Frances Sutherland, Ben Moore, Hany Dimitry and Does 1-8, alleging they breached their duty of good faith and fair dealing.

According to the complaint, starting in August, Rivera has suffered and continues to suffer substantial losses in earnings, bonuses, and benefits, and sustained anguish, humiliation, nervousness, tension, anxiety, and depression due to the actions of the defendants. The suit says Rivera was subjected to a hostile working environment, was physically attacked and then terminated Aug. 28 in retaliation for reporting that he was attacked on the job site. 

The plaintiff alleges the defendants blamed him for the intolerable working environment created by the defendants themselves, and terminated his employment on false reasons.

Rivera seeks trial by jury, compensatory damages of more than $280,000 and, according to proof, punitive damages, attorney fees, costs, interest and all further relief the court considers proper. He represents himself as attorney pro per in Fresno.
