Insurance carrier alleges equipment manufacturer owes more than $115,000

FRESNO — An insurance carrier is suing an equipment manufacturer, alleging breach of contract and owing more than $115,000.

Star Insurance Company filed a complaint Aug. 30 in Fresno County Superior Court against Tanimura & Antle Inc., Titan Manufacturing and Does 1-100, alleging they illegally obtained profit through distribution of a substandard product.

According to the complaint, on Aug. 31, 2015, Star Insurance was forced to make payments under the insured's policy in the amount of $115,494.58, when a Tanimura & Antle  employee sustained serious injuries and damages, as a result of operating a defective drip irrigation tape retriever that was manufactured by the defendants. 

The plaintiff alleges the defendants failed to include adequate warnings that would alert Star Insurance to the potential risks of serious injury, and refused to pay benefits to the employee for the workers' compensation claim.

Star Insurance seeks trial by jury, judgment of $115,494.58, costs of suit and all further relief the court deems proper. They are represented by attorney Lee M. Mendelson of Mendelson Goldman in Sherman Oaks.
