SAN DIEGO — A San Diego County man has filed a class action lawsuit against Equifax, alleging negligence, unfair competition and unjust enrichment.
Nathan Turner filed a complaint, individually and on behalf of all others similarly situated, Oct. 5 in U.S. District Court for the Southern District of California against Equifax Inc., alleging failure to exercise reasonable care and prudence in protecting members' personal information.
According to the complaint, in May, Turner and other similarly situated individuals suffered injuries to their personal and confidential information. The suit says this was the result of Equifax's poor security barriers that resulted in a massive data breach, wherein consumers' confidential data were stolen.
The plaintiffs allege Equifax failed to properly secure and safeguard its users’ personal information and failed to immediately notify users of the hack.
Turner seeks trial by jury, maintain the case as a class action, appoint class representative and counsel, compensatory and statutory damages, restitution, punitive damages, costs of action, attorney fees, expenses, expert fees, interest and all further relief the court deems just. The plaintiffs are represented by attorney Natasha N. Serino of Law Offices of Alexander M. Schack in San Diego.
