California produce company alleges distributors owe more than $57,000

SACRAMENTO — A California produce company is suing distributors, alleging they owe more than $57,000 for breach of contract, negligence and unjust enrichment.

King Fresh Produce LLC filed a complaint Oct. 4 in U.S. District Court for the Eastern District of California against CH Robinson Worldwide Inc., and CH Robinson Company Inc., alleging they breached their duties of good faith and fair dealing.

According to the complaint, starting in April 2016, King Fresh Produce has suffered economic damages from having sold and shipped perishable agricultural commodities to defendants in the principal amount of $57,333. Although, the defendants received the produce in good condition, the suit says, they failed to safely and promptly transport and deliver the commodities and have refused to pay amount due. 

The plaintiff alleges the defendants failed to pay the amounts due, failed to fulfill their responsibilities for proper loading and transport, and failed to properly supervise and maintain the refrigeration unit.

King Fresh Produce seeks trial by jury, damages in the principal amount of $57,333, finance charges or interest, attorney fees, costs of suit and all relief the court deems just. It is represented by attorney Bart M. Botta of Rynn & Janowsky LLP in Newport Beach.
