Fresno County couple accuses real estate business of contract breach

Contract 09

FRESNO — A Fresno County couple is suing a real estate business, alleging breach of contract, concealment, breach of fiduciary duty, negligence, intentional and negligent misrepresentation.

Dennis Noorigian and Debra Noorigian filed a complaint Sept. 1 in Fresno County Superior Court against Zarina Rosenfeld, Michael Rosenfeld, Michael Rosenfeld Inc., Shaver Lake Real Estate Inc. et al., alleging they breached their duties of good faith and fair dealing.

According to the complaint, the Noorigians have incurred substantial monetary damages, attorney fees, and financial hardship by purchasing a property that the defendants and their agents have bought, superficially repaired, misrepresented and sold, while concealing defects to several areas of the property at 42268 Blue Meadow Lane, Shaver Lake.

The plaintiffs allege the defendants failed to disclose all known material facts and defects affecting the property, and enticed the Noorigians into purchasing a defective property.

The Noorigians seek trial by jury, general and punitive damages, rescission of the contract, costs of suit, interest, and all relief the court deems just. They are represented by attorney Brian K. Cuttone of Cuttone & Associates in Fresno.
