Customer accuses auto distributor of violating TILA

LOS ANGELES — A Los Angeles County woman is suing an auto dealer, alleging violation of the Truth in Lending Act (TILA).

Susana Mendoza filed a complaint Oct. 4 in U.S. District Court for the Central District of California against Sidney Auto Sales Inc., alleging the auto distributor obtained profit through unfair or deceptive trade or commerce.

According to the complaint, on Dec. 20, 2016, Mendoza suffered damages from the purchase of a 2008 Pontiac G6 from the defendant for a total payment of $10,547.74. The suit says Sidney Auto Sales breached the sales contract by not including a proper disclosure statement as required by TILA. 

The plaintiff alleges the defendant failed to disclose the number, amount, and due dates or period of payments scheduled to repay the total of payments in the disclosure statement that it provided to Mendoza.

Mendoza seeks trial by jury, statutory damages, actual damages, attorney fees, court costs, interest, and all the court deems just. She is represented by attorneys Elliot Rosenberger and Joshua Biletsky of Biletsky Rosenberger in Los Angeles.
