SACRAMENTO — A man with disabilities is suing a Tahoe, California, marina and yacht club, alleging disability discrimination, failure to uphold the Americans with Disabilities Act (ADA) regulations and violation of civil rights.
Richard Rehhaut filed a complaint Oct. 10 in U.S. District Court for the Eastern District of California against Tahoe Keys Marina and Yacht Club LLC and LT Food and Spirits Inc., alleging they failed to provide full and safe equal access to its restroom facilities.
According to the complaint, Rehhaut went to the restaurant owned and operated by the defendant in August 2016 and August 2017 and suffered discomfort both times. The suit says the defendants failed to provide proper restroom accommodations to Rehhaut, leading to difficulty and frustration.
The plaintiff alleges the defendants failed to ensure that the accessible facilities were available to Rehhaut, failed to provide adequate floor space, and failed to remove architectural barriers where such removal is readily achievable.
Rehhaut seeks trial by jury, actual damages of at least $4,000, injunctive relief, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
