SAN DIEGO — A San Diego County man has filed a class action lawsuit against an Orange County company, alleging violation of the Telephone Consumer Protection Act (TCPA).
Jonathan Shawn Bush filed a complaint, individually and on behalf of all others similarly situated, Oct. 9 in U.S. District Court for the Southern District of California against InboundProspect Inc., doing business as Senior Mobility Care alleging violation of TCPA through intrusive and unwanted phone calls.
According to the complaint, Bush and other similarly situated recipients have suffered from abuse and harassment, including invasion of their privacy, as a result of the unsolicited calls from agents of Senior Mobility to advertise its goods and services. Moreover, the suit says, the calls were unlawfully made using an automatic telephone dialing system.
The plaintiffs allege Senior Mobility Care contacted them without express consent, unlawfully utilized an automatic dialer, and invaded the plaintiffs' rights to privacy and seclusion.
Bush and the other plaintiffs seek trial by jury, injunctive relief, statutory and treble damages of $1,500 for each violation, and all relief the court deems just and proper. They are represented by attorneys Joshua Swigart and Kevin Lemieux of Hyde and Swigart in San Diego, and by Abbas Kazerounian of Kazerouni Law Group APC in Costa Mesa.
