FRESNO — A Fresno County man is suing Ford, alleging breach of implied warranty.
Dustin Mello filed a complaint Sept. 8 in the Fresno County Superior Court against Ford Motor Company and Does 1-100, alleging violation of the Song-Beverly Consumer Warranty Act.
According to the complaint, on Sept. 23, 2016, Mello leased a new 2016 Ford Explorer from Ford but despite receiving an express written warranty relating to the vehicle, the car was not in a merchantable condition, was not safe and did not conform to the quality and safety guidelines reasonably expected of a motor vehicle.
The plaintiff alleges Ford failed to repair, replace or repurchase the Ford Explorer after its authorized repair facility notified the defendants of the defect.
Mello seeks trial by jury, rescission of the lease agreement, incidental and consequential damages, attorney fees, costs of suit, pre-judgment interest, and all other relief the court deems proper. He is represented by Robert L. Starr of The Law Office of Robert L. Starr, APC in Calabasas.
