Van driver, passengers blame trucking company for crash

FRESNO — A van driver and passengers are suing a trucking company, alleging negligence while driving  a tractor trailer.

German Martinez Menia, Gloria Portillo and William Barahona Portillo filed a complaint Sept. 15 in Fresno County Superior Court against Carlucci Transport, and Does 1 through 50, inclusive, alleging the defendants negligently drove the tractor trailer so as to cause it to weave into the eastbound lane on Belmont Avenue near Mendota, striking another vehicle.

According to the complaint, on Aug. 6,  Menia was driving his family van with Gloria Portillo and William Barahona Portillo as passengers when their van was struck by a Carlucci tractor trailer on Belmont Avenue, causing the van to overturn and roll several times. The suit says the plaintiffs sustained physical, mental and emotional damages and injuries. 

The plaintiffs allege Carlucci Transport and Does 1 through 50 entrusted, managed, drove and operated the tractor trailer, causing it to collide with another vehicle, resulting in physical and property damage.

The plaintiffs seek trial by jury, economic and non-economic damages, interest according to law, costs, attorney fees and all other relief the court considers proper. They are represented by attorney Peter N. Kapetan of Kapetan Brothers, LLP in Fresno.
