FRESNO — A Fresno County woman consumer is suing a Fresno car dealership, alleging violations of the Consumers Legal Remedies Act (CLRA), intentional misrepresentation, negligent misrepresentation, breach of implied warranty, and unfair competition.
Kim Kirkland filed a complaint Sept. 18 in Fresno County Superior Court, against Paris Motorz, Edgar Tanassi President, Tanassi 1 Inc., Jose Marquez and Does 1-20, alleging they breached their duties of good faith and fair dealing.
According to the complaint, Kirkland has suffered monetary damages from purchasing a secondhand 2015 Ford Fiesta from the defendants with a down payment of $ 5,000. The suit says Kirkland discovered later the vehicle was actually involved in at least two major collisions and sustained severe mechanical and structural damages.
The plaintiff alleges the defendants failed to disclose the known accident damage and other defects and induced Kirkland plaintiff to purchase the vehicle at an inflated sales price.
Kirkland seeks trial by jury, declaratory, equitable, and/or injunctive relief, rescission and restitution of $5,000, general and punitive damages, and all relief the court deems just. She is representing herself.
