Customer alleges Ford failed to conform to warranties

FRESNO — A Fresno County man is suing Ford, alleging breach of express and implied warranty.

Fernando Perez filed a complaint Sept. 13 in Fresno County Superior Court against Ford Motor Company, and Does 1 through 20, alleging violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, on June 14, 2015, Perez signed a conditional sales contract to purchase a Ford Focus from Ford that was accompanied by the Ford's express vehicle warranty, signifying the vehicle is fit for the purpose for which it was being purchased. 

Perez says the vehicle failed to conform to the terms of the warranties and has been in the repair facilities at least six times due to defects. 

The plaintiff alleges the defendants failed to conform the vehicle to its express warranty after a reasonable number of repair attempts and failed to replace the vehicle or refund costumer's purchase price.

Perez seeks trial by jury, rescission of the contract, actual and exemplary damages, attorney fees, costs of suit, prejudgment, and fall other relief the court deems just and proper. He is represented by attorney Alicia L. Hinton of Law Office of A.L. Hinton in Fresno.
