SACRAMENTO — A South Korean investor is suing Clovis hotel owners and operators, alleging breach of contract and false promise.
Hyun Ju Shin of Seoul filed a complaint Oct. 11 in U.S. District Court for the Eastern District of California against Robert Young Yoon, Kyoung Mee Yoon, Kyoung Sup Yoon, Y&Y Property Management Inc., et. al., alleging the defendants failed to observe corporate formalities, abide by corporate bylaws or inform shareholders of corporate meetings, decisions and relevant financial, corporate or managerial information.
According to the complaint, on Jan. 6, 2013, Shin made capital contributions to purchase Cascade Hospitality owned and operated by the defendants' in the amount of $1.51 million. The suit says the parties agreed on a contract wherein the plaintiff is a shareholder and would receive 99 percent interest share of the Cascade Lodge in Clovis. Shin says he was not given any of the shares, business documents or other business decisions that a partner should have.
The plaintiff alleges the committed malicious acts with the intent to defraud a shareholder of the equity share of profits, mismanaged funds, made illegal transfers, embezzled monies and failed to manage the business as a reasonably prudent manager should. He says he has been harmed financially by at least $430,530.
Shin seeks trial by jury, general, special, punitive and exemplary damages, plus pre- and post-judgment interest, attorney fees, costs of suit and all other relief the court deems just and proper. He is represented by attorney David H. Rho of Los Angeles.
