Customer alleges insurance firm breached contract

FRESNO — A customer is suing an insurance company, alleging breach of contract.

Louie Azevedo filed a complaint Sept. 13 in Fresno County Superior Court against Amco Insurance Company, alleging breach of good faith and fair dealing.

According to the complaint, Azevedo has pursued Amco after an under-insured motorist's insurance claim regarding an accident involving a negligent and under-insured driver-at-fault, on Nov. 21, 2007, along state Route 41. However, the suit says, Amco has refused to offer additional sums to the plaintiff and, instead, continues to delay, hinder and otherwise obstruct Azevedo from receiving benefits. 

The plaintiff alleges Amco has threatened to depose Azevedo's medical providers to induce him to settle for a lesser amount than due him, failed to fairly evaluate the case, and refused to offer any reasonable settlement amount in a timely manner.

Azevedo seeks trial by jury, special, general, economic, emotional distress, incidental and consequential damages, attorney fees, interest, costs of suit, punitive damages, and all relief the court deems just. He is represented by attorney James H. Wilkins of Wilkins, Drolshagen & Czeshinski LLP in Fresno.
