Tenant alleges property owner's negligence led to infestation of insects, rodents

FRESNO — A Fresno County apartment tenant is suing her property owner, alleging negligence.

Viengngeun Sasone filed a complaint Sept. 14 in Fresno County Superior Court, against Jose Rosas and Does 1-50, alleging they failed to provide a safe and secure environment for its tenants.

According to the complaint, in October 2015, Sasone she made several complaints to Rosas about the uninhabitable conditions of the property at 4351 Turner Ave., Fresno. The suit says the complaints included infestation of insects and rodents, deteriorated and unsanitary fixtures, and the presence of mold/mildew to which the defendants refused to act upon. 

As a result, Sasone says she continues to suffer physical injury, anxiety, discomfort, annoyance, and distress, all to her detriment and damage. 

The plaintiff alleges the defendants failed to properly maintain and repair the premises, failed to correct the substandard conditions at the property, and posed a serious threat and danger to tenants' health and safety.

Sasone seeks trial by jury, judgment for general, special, exemplary, punitive and statutory damages of between $100 and $5,000, attorney fees, costs of suit, and all other relief the court deems just.
